These online shopping Terms and Conditions apply to all purchases ordered online through our TF Value-Mart E-Store located at estore.tfvaluemart@com.my and TF Value-Mart mobile application. Please read them carefully and print a copy for future reference.

1.1 General

1.1 This TF Value-Mart E-Store is owned and operated by TF Value-Mart Sdn. Bhd. (“Company”).

1.2 Your access to, and use of the materials contained in, the TF Value-Mart E-Store is conditional on your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document or elsewhere on the TF Value-Mart E-Store. By registering and/or using the TF Value-Mart E-Store, you agree to be bound by these Terms and Conditions.

1.3 The Company reserves the right to amend the Terms and Conditions at any time without notice. You are therefore strongly recommended to read these Terms and Conditions regularly. Your continued use of our TF Value-Mart E-Store following such changes constitutes your agreement to be bound by the new Terms and Conditions.

2.0 Registration and account security

2.1 To access the TF Value-Mart E-Store, you will be required to register and sign-up for an account (“Account”) and select a username and password. To register with the TF Value-Mart E-Store, you must be:

i) a natural person over eighteen (18) years of age; or

ii) a corporate legal entity.

2.3 It is your responsibility to ensure that the details provided by you on registration, or at any time are accurate, up-to-date and complete. You must notify us immediately of any changes to the information that you provided when registering by updating your personal details.

2.4 The Company has the absolute discretion to:

                        i) refuse registration of a potential customer;

ii) restrict, suspend or terminate your access to all or any part of the TF Value-Mart E-Store; and/or

iii) suspend, terminate or deactivate your Account, at any time without assigning any reason whatsoever.

2.5 The Company reserves the right to deactivate your Account if it has been inactive for a period of one (1) year or more, or if you are in breach of any of our Terms and Conditions.

2.6 You authorize us to assume that any person(s) using the site with your Account is/are either you or is/are authorized to act on your behalf.

2.7 You shall be responsible for any purchases and activities that are submitted under your Account and you agree to indemnify the Company for any and all claims and damages whatsoever incurred and sustained by us or any third party arising from the actions of any person placing orders through this platform using your Account. The Company shall bear no responsibility or liability for any loss, damage, cost, expenses or liabilities arising as a result of or in connection with the wrongful or fraudulent use of your Account.

3.0 Information collected and use of information

3.1 The Company collects the details provided by you on registration together with information we learn about you from your use of our service and your visit to the TF Value-Mart E-Store.

3.2 By using the TF Value-Mart E-Store, you expressly accept and give your unconditional and irrevocable consent that we may collect and/or process and/or use and/or disclose any information about your demographics in any manner which does not reveal your identity for the purposes of marketing, promotional, strategic development, research and customer care.

4.0 Intellectual property

4.1 The contents of the TF Value-Mart E-Store is protected by copyright, trademarks, database and other intellectual property rights. You may not reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the TF Value-Mart E-Store without prior written permission from the Company.

5.0 Pricing and products

5.1 The Company shall make every effort to ensure that prices, details and sizes of the products on this platform are up to date. However, pricing errors may occur from time-to-time and we do not guarantee that the pricing, images, product description, or other product or promotional information provided will be accurate and error-free. You agree that the Company shall not be liable for any errors in the pricing and product or promotional information listed on the TF Value-Mart E-Store.

5.2 Prices displayed on the TF Value-Mart E-Store are subject to change without prior notice and all orders are subject to: 

i) the issuance of a Confirmation Order by us; and

ii) stock availability.

5.3 All pictures and images of the products displayed on the TF Value-Mart E-Store site are for illustration purposes only in order to help customers recognise the products. The actual size, dimension and colour of the products may differ.

5.4 Prices charged for purchases of goods on the TF Value-Mart E-Store are:

i) only applicable on the day of order; and

ii) may be different from those charged in our physical stores. 

5.5 For items ordered by weight, the Company reserves the right to supply goods with a weight difference. As such, the amount you receive may exceed or be less than the amount requested. However, we will endeavour to provide you with an amount as close to the requested weight as possible.

6.0 Online orders

6.1 Before you start placing an order, you need to select a store in TF Value-Mart E-Store to process your delivery.

6.2 Once you have selected the products that you wish to order, you will then be shown (on the platform) the charges you must pay including taxes (if applicable) and any applicable delivery charges.

6.3 The Company reserves the right to limit your order or the quantity of a particular product that you may order.

6.4 TF Value-Mart E-Store purchase requires a minimum spending of RM50 per order (excluding taxes and delivery charges).

6.5 Customer shall pay for the order in full at the time of ordering. Until and unless we accept your full payment of the order, we reserve the absolute right not to process your order.

6.6 When you place an order with us, we will confirm your order by sending you a Confirmation Order via email and/or SMS containing the order receipt and goods collection details. 

6.7 No amendment to an order is allowed once the order is processed.

6.8 Customer has to choose either to collect the goods at the selected store or for the goods be delivered to a designated delivery address.

6.9 The TF Value-Mart E-Store service is available for non-commercial and domestic use only. TF Value Mart reserves the absolute right to refuse orders from businesses or that we consider are for commercial or other non-domestic concerns.

7.0 Availability

7.1 The Company shall make every effort to ensure products displayed on the TF Value-Mart E-Store are in stock, subject to the final stock availability at the selected store. The Company does not guarantee the availability of goods.

7.2 To ensure goods are available to all customers, the Company has the right to set maximum limits in advance for the purchase of individual items by a single customer.

7.3 The Company reserves the right to reject the order if any of the products or services requested is unavailable.

7.4 If the quantity of a particular product requested by you cannot be 100% fulfilled due to factors beyond the Company’s control, we shall only deliver to you the quantity that is available and a Confirmation Order will not be issued in respect of that product.

7.5 Short deliveries to customer will be compensated via an online gift voucher of the same value.

8.0 Payment 

8.1 Once your order has been confirmed, you shall proceed to make your payment in full online.

8.2 Payment for all confirmed orders shall be made in Ringgit Malaysia (RM). We accept payments using approved debit and credit cards. We also accept payment via bank transfers and selected e-Money / e-Wallets.

8.3 The Company shall not be obliged to supply the product to you until we have accepted your full payment of the order.

8.4 The Company will not accept cash, cheques, food stamps or third-party coupons as payment for online orders.

8.5 You may earn reward points (“INFINITI”) by buying all product listed at all TF Value-mart E-Store. Reward points will be credited to Customer’s Account upon complete payment of a successful transaction and processed the order.

8.6 All of the INFINITE Card Terms and Conditions shall be applicable to customers who registers with any TF Value-mart E-Store.

9.0 Goods collection at store

9.1 Customers can choose to collect their goods directly from selected TF Value-Mart E-Store based on the following timeslots:

9.2 The location of the TF Value-Mart E-Store for own collection is based on customer’s own selection in the TF Value-Mart E-Store.

9.3 If you are not personally available to collect the goods, an authorized representative may collect on your behalf provided you had called our customer service to update the representative information. The representative must be over 18 years of age.

9.4 We will not entertain requests for change of store for collection after order confirmation is issued.

9.5 No delivery charges apply for orders collected at store. However, we reserve the right to charge a minimum administration charges / delivery charges for any special redelivery arrangement or return request.

9.6 For you to collect your order, please show us your Confirmation Order as proof of order.

9.7 Confirmed orders that are not collected during the designated timeslots as stated in Clause 9.1 above will be forfeited without further notification to you.

10.0 Home delivery

10.1 The Customer can choose for the ordered goods to be delivered to a designated address, which can be different from the Customer’s registered address in TF Value-Mart E-Store.

10.2 The Customer’s delivery address must be located within a range of postcodes that are pre-approved by the Company.

10.3 The Company reserves the right to refuse delivery to addresses that are not located within the pre-approved postcodes.

10.4 Your order will be processed and delivered according to the following delivery timeslots:

10.5 The Customer can choose to select a different delivery time but it cannot be earlier than the original pre-approved timeslot based on your ordering time.

10.6 If you choose to select a different delivery time, it cannot be more than 24 hours later than the original pre-approved timeslot based on your ordering time.

10.7 Whilst we make every effort to deliver all ordered goods in the agreed time, the Company will not be liable if it fails to do so in part or in full due to circumstances beyond its reasonable control.

10.8 Your order will be delivered to you via our delivery team or the service of a courier service, delivery company or personnel appointed by the Company.

10.9 Our delivery team will deliver the Customer’s order to the main entrance of the delivery address. At the Customer’s request, our delivery team may carry the Customer’s order into the delivery address, for example, to a particular floor in an apartment block or into the kitchen (“House”) but only if:

i) the delivery team obtains the Customer’s permission,

ii) 

iii) the driver believes that it is safe and practical to do so as per the Customer’s requests;

iv) 

v) there are no obstacles preventing the delivery team from entering your House; and

vi) 

vii) once the delivery team enters your house, you assume responsibility and you hereby agree to pay for any loss, cost, damage to property or for any personal injury or death of the delivery team arising out of, as a result of, or in connection with your actions or omissions.

10.10 The Company reserves the right to deliver only to the main entrance of the delivery address.

10.11 If there is nobody authorised or qualified to receive the goods at the agreed time and place specified by the Customer, we will leave a notification of attempted delivery and the Customer will need to contact customer services to re-arrange for delivery. 

10.12 If Customer requests for redelivery, the Company is entitled to charge an additional re-delivery fee of RM10 for the service.

10.13 If the delivery includes alcoholic drinks or any other age-restricted items, you hereby agree to ensure that a person of 21 years of age or older with appropriate identification is present or is authorised to collect the delivery of the above-mentioned items. The Company reserves the right not to deliver any age-restricted product to anyone who is, or appears to be under the age of 21 years old, and to charge the customer an additional re-delivery fee of RM10.

10.14 The Customer is required to contact the customer service hotline for the following circumstances:

i) if there are any changes in the delivery address/contact details made between submission of order and delivery date;

ii) rescheduling the delivery of the goods;

iii) changes to the delivery time; and

iv) request for the specific delivery period.

11.0 Delivery charges

11.1 For online orders of RM100 and above, no delivery fee shall be charged.

11.2 For orders below RM100, a minimum delivery charge of RM8 per trip will be applicable.

11.3 Applicable delivery charges will be calculated during your online ordering process and will form part of your total invoice amount.

11.4 Customer shall pay for the order together with the delivery charges (if any) in full at the time of ordering. Until the time when we accept your full payment of the order and delivery charges (if any), we reserve the right not to process your order.

12.0 Cancellation and amendment of order

12.1 The Company reserves the right to cancel an order if the product is not available for any unforeseen reason(s). In this case, we will notify you and refund the amount paid. The refund method shall depend on the payment method and will be subjected to the terms and conditions imposed by the financial institutions.

12.2 Customer can cancel the order if the order has not been processed by our fulfilment team or yet to be delivered. If the Customer needs to cancel the order after the order has been processed, the Customer may contact the Customer Service hotline of the selected outlet, stated at TF Value-Mart E-Store.

12.3 If Customer requests for cancellation, the Company will charge an administrative cost of RM10 for the service. 

12.4 No amendment to an order is allowed once the payment has been made and after the order has been processed. To add additional item(s), kindly make a second order prior to the delivery and inform us via Customer Service hotline.

13.0 Exchange, return and refunds 

13.1 You shall examine the goods immediately upon collection / taking delivery for any shortages, deficiencies and/or damages.

13.2 For home delivery, claims (if any) must be lodged at our appointed personnel, delivery team, courier service or the delivery company at the time of taking delivery; otherwise we shall have the absolute discretion to refuse your claim.

13.3 For collection at the selected store, claims (if any) must be lodged at the store’s customer service counter at the time of collection; otherwise we shall have the absolute discretion to refuse your claim.

13.4 For shortages, deficiencies and damages that are claimed at the time of collection / taking delivery and subsequently approved by the Company, a refund shall be made to Customer within five (5) to twenty-one (21) days to the same payment card/account via the banking or e-Money / e-Wallet Issuers selected and processed during the ordering/check out. 

13.5 For products which is found to be expired, defective and/or damaged inside the packaging AFTER collection / taking delivery, you may return the defective product (except for fresh items and undergarments) to the customer service counter of  the selected store within seven (7) business days from the date of collection / taking delivery. You must present a valid receipt of the purchase before replacement of the products or refund can be made.

13.6 Goods returned for a refund shall be refunded at the price which you have paid and the amount stated at the receipt of purchase.

13.7 In the event of a refund, all reward points received for the purchase of the refunded goods will be removed from the INFINITE card.

14.0 Miscellaneous

14.1 If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. 

14.2 You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

14.3 Third-party links on the TF Value-Mart E-Store website may direct you to third party websites that are not affiliated with us. The Company is not responsible for examining or evaluating the content or accuracy of those third-party websites. 

14.4 The Company does not warrant and will not have any form of liability or responsibility for those third-party materials, websites or any form of purchases or payment made on those third-party websites.

14.5 Any suggestion, feedback, idea, review submitted to TF Value Mart without any request via any medium will be treated as non-confidential and non-proprietary and we shall have the royalty-free, continuous, unchangeable and transferable right to use, copy, distribute, display, publish, perform, sell, lease, transmit, adapt, create derivative works from such posting or submissions by any means and in any form, and to translate, modify, reverse-engineer, disassemble, or recompile such posting and/or submission.

14.6 We may, but are under no obligation to, monitor, edit or remove content that we determine, in our sole discretion, is unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions.

14.7 By sending and/or posting your comments, you agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the TF Value-Mart E-Store or any related website.

14.8 You agree to not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

15.0 Promotions

15.1 Any form of promotion introduced by TF Value-Mart E-Store will be subject to additional terms and conditions which can be found on the website and are hereby incorporated by reference into these Terms and Conditions. The promotions will only be valid for a time specified by TF Value-Mart E-Store and while stocks last. No compensation or cash will be offered in the event that the goods on promotion are no longer in stock.

16.0 Limitations

16.1 You shall not use TF Value-Mart E-Store for any illegal or unlawful purposes including but not limited to the following:

i) disseminating any illegal, harassing, libellous, defamatory, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material; 

ii) transmitting material which encourages any form of conduct that would constitute a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations, or codes of practice;

iii) gaining access to unauthorised access to other digital or computer system;

iv) interfering with any other person’s use or enjoyment of the TF Value-Mart E-Store;

v) breaching any laws pertaining to the use of public telecommunication networks; and/or

vi) making, transmitting or storing electronic copies of materials protected by copyright without the permission of the copyright owner.

16.2 To the extent permitted by law, the Company (which shall include its employees, directors, agents, representatives), excludes all liabilities (whether arising in contract, in negligence or otherwise) for loss or damage which you or any third party may incur in connection with our TF Value-Mart E-Store, our services, and any website linked to our TF Value-Mart E-Store and any content or material posted on it. Your exclusive remedy with respect to your use of the TF Value-Mart E-Store is to discontinue your use of the TF Value-Mart E-Store.

17.0 Applicable laws

17.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia and any disputes shall be decided by the Malaysian courts.

18.0 Indemnification

18.1 You agree to indemnify and hold the Company and its officers, directors, representatives, agents and employees, harmless from any claim or demand, including reasonable solicitors fees, made by any third party due to or arising out of your unlawful use of the TF Value-Mart E-Store, violation of these Terms and Conditions, or the infringement by you, or any other user of your Account, of any intellectual property or other right of any person or entity.

19.0 Disclaimer

19.1 The Company do not guarantee, represent or warrant that your use of our TF Value-Mart E-Store will be uninterrupted, timely, secure or error-free and that the service will be fault free. Your access to the TF Value-Mart E-Store may occasionally be restricted to allow for repairs, maintenance or introduction of new facilities or services and we will attempt to restore the service as soon as we reasonably can.

19.2 The Company makes no guarantee that materials on the TF Value-Mart E-Store are appropriate or available for use in locations outside Malaysia, and accessing the TF Value-Mart E-Store from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside Malaysia, you do so on your own risk and are responsible for compliance with local laws.

19.3 This TF Value-Mart E-Store and all information contained herein is provided on an "as is" and “as available” basis without any implied or express warranty including of any implied warranty as to title, quality, merchantability, fitness for purpose, or non-infringement.
